According to the RERA Act 2016, developers and builders have to disclose the carpet area of the units they sell, make buyers aware of the carpet area, and quote prices. The flat area is calculated in three different ways, including carpet area, built-up area, and super built-up area. The carpet area is the net usable area, whereas built-up areas include carpet areas plus the authority’s certified extra areas. Super built areas include carpet areas, built-up areas, and common areas like stairs, lobbies, and galleries.

New standard defining carpet area calculation:

Maharashtra Real estate authority issued a circular in which it has  asked builders and developers not to include a verandah, terrace, and balcony in the carpet area even as internal walls are included in the calculation. The new circulation made it mandatory for developers to adhere to this standard while drawing up sale agreements. This new rule is expected to curb the malpractices of selling flats based on the measurement of built-up areas and the miscalculation of available usable areas, including common facilities like verandah, staircase, and lift. However, the rule of selling flat based on carpet area was under the Maharashtra Ownership of Flats act but was rarely enforced. The earlier definition of carpet area differed for different builders leaving customers confused. But now, with this new MahaRERA Act, builders can be sued if he falters. 

Balcony, verandah, and terrace are not included in the carpet area:

The carpet area excluded the area covered by outer walls, including verandah, balcony, and exclusive open terrace areas. However, it included internal partition walls of the apartments. So corner apartments get more carpet area. The new RERA rule ensured that if the property is declared to have a 1000 sq feet area, it will have a 1000 sq feet carpet area excluding verandah, balcony, and open terrace. If rules are violated, builders will be fined up to 5% of the total cost under section 61 of the RERA Act.
